McDonald v. Chicago: DONE

Postby LeoAtrox » Mon 28 Jun, 2010 9:19 am

By a 5-4 vote, the Second Amendment of the US Constitution is now applied to the States by the "due process" clause of the Fourteenth Amendment.

This is great news. It will interesting to see how this will effect some of the restrictive gun laws in liberal states.

I just wonder when someone will follow up in DC. They still have a problem there.

Congress is still working on DC. They're slowly moving legislation through congress that would severely restrict Washington's ability to self-regulate firearms ownership and usage.

Oh ... And McDonald v. Chicago is not completely "done" ... It's been remanded to the Circuit court with new direction (Second Amendment applies) and the Chicago ban is unenforceable--though, until a Circuit court ruling, the ban is still in place and folks' registration requests (supposing there are any since the ban is now unenforceable) will probably go unanswered.

While happy with the outcome, I am disgusted with the fact that there are 4 judges in our highest court that do not think this applies to everyone in this country.

I guess I need to read what their reasoning is.

Saw one of them's (a male, don't remember his name) dissenting comments; same old stuff about hunting... and violence committed by the bourgeoise who aren't intelligent or cultured enough to own weapons - that is, your basic American citizen.

They simply don't get it, up there in the ivory towers... must be like the puzzlement clouding the minds of the French aristocracy taking their first (and last) rides in a tumbril. Deservedly so.

Now Chicago responds by passing new laws making it a pain in the a$$ to own a handgun.

Some parts of the new law will be challenged; but it is far better than it was. At least now folks in Chicago can keep an operable handgun in their own homes. (And may own more in locked/unoperable condition.)
